1 About this policy

Himalay Homestays operates accommodation services in Old Dehradun near Tilak Road, Uttarakhand, India. In this policy, “Himalay Homestays”, “we”, “us” and “our” refer to the homestay and its authorised representatives.

This policy applies when you visit our website, send an enquiry, contact us by phone, email or messaging service, make a reservation or stay at the property.

2 Information we may collect

Depending on how you interact with us, we may collect the following categories of information:

  • Contact information: Your name, phone number, email address and other contact details you voluntarily provide.
  • Booking information: Check-in and check-out dates, number of guests, room preference, special requests and reservation history.
  • Payment information: Payment status, amount and transaction reference. Full card, UPI or banking credentials are normally processed by the relevant payment provider and are not intended to be stored by us.
  • Check-in information: Government-issued identification and guest details where required for verification, safety or legal compliance.
  • Technical information: IP address, browser type, device information, website activity, referring page and cookie-related data.
  • Communications: Enquiries, feedback, reviews, complaints and other messages exchanged with us.

3 How we use your information

Terms & Conditions

These terms apply when you use our website, contact us about accommodation, make a reservation or stay at Himalay Homestays.

1 Acceptance and eligibility

By using this website or making a booking, you agree to these Terms & Conditions and any booking-specific terms shown before payment or included in your booking confirmation.

The person making the booking must be at least 18 years old, provide accurate information and have authority to accept these terms on behalf of every guest included in the reservation.

2 Availability and booking confirmation

Availability displayed on the website or communicated during an enquiry may change until a booking is confirmed.

A booking is considered confirmed only after you receive written or electronic confirmation from us and any required advance or full payment has been received successfully.

You are responsible for checking guest names, dates, room type, number of guests, price and any special conditions shown in the confirmation. Please notify us promptly if any information is incorrect.

3 Rates, taxes and payment

  • Rates are generally displayed in Indian Rupees unless another currency is clearly stated.
  • Applicable taxes, service fees or additional charges will be shown during booking or communicated before confirmation wherever reasonably possible.
  • Special offers, discount codes and promotional rates may have separate conditions and limited availability.
  • Payment must be made using an accepted method and within the time stated in the booking instructions.
  • A failed, reversed or unauthorised payment may result in the reservation remaining unconfirmed or being cancelled.
  • Payment providers may apply their own processing, verification and security terms.

4 Cancellation, modification, refund and no-show

Booking-specific policy applies

The cancellation, refund, modification and no-show terms displayed during booking or stated in your confirmation form part of your reservation and will apply to that booking.

If cancellation terms have not been clearly provided, please contact us and obtain written clarification before completing payment. Do not assume that a rate is refundable unless it is stated as refundable.

  • Date or room changes are subject to availability and may result in a different rate.
  • Late cancellation, failure to arrive or early departure may result in charges under the confirmed booking policy.
  • Any approved refund will normally be returned through the original payment method where possible.
  • Bank and payment-provider processing times are outside our direct control.

5 Check-in, check-out and identification

Check-in and check-out times will be shown in the booking confirmation or communicated before arrival. Early check-in and late check-out are subject to availability and may involve an additional charge.

Adult guests may be required to present a valid, government-issued photo ID at check-in. Foreign nationals may be required to provide passport, visa and other documents required by applicable law.

We may refuse or delay check-in where identity cannot reasonably be verified, required information is not provided, payment remains outstanding or permitting the stay would violate applicable law.

6 Occupancy, children and visitors

Only registered guests may occupy the room. The number of adults and children must not exceed the confirmed room capacity unless we approve a change.

Children must be supervised by a responsible adult. The booking guest is responsible for the conduct and safety of children and other guests included in the reservation.

Unregistered visitors may be restricted or require prior approval for safety, privacy and property management reasons.

7 Guest conduct and property rules

Guests must behave respectfully towards other guests, neighbours, staff and the property. Guests must also follow reasonable safety and house instructions communicated before or during the stay.

  • Excessive noise, nuisance, harassment and disruptive behaviour are not permitted.
  • Illegal activity, dangerous substances and weapons are prohibited.
  • Parties, events, commercial photography or unauthorised business activity require prior written approval.
  • Smoking, alcohol consumption and pets are permitted only where allowed by the property’s communicated rules and applicable law.
  • Rooms and shared spaces must be used responsibly and left in reasonable condition.

Serious or repeated violation may result in refusal of service or termination of the stay without limiting any other rights available under the confirmed booking terms or applicable law.

8 Damage, loss and additional charges

The booking guest is responsible for damage caused by themselves, accompanying guests or approved visitors, except for reasonable wear and tear.

We may request payment for documented repair, replacement, missing items, additional cleaning or other reasonable costs caused by misuse of the property.

Guests should report damage or maintenance issues as soon as they are noticed. Personal belongings remain the guest’s responsibility. Any lost-and-found item will be handled reasonably, but storage and return cannot be guaranteed indefinitely.

9 Amenities and service interruptions

We make reasonable efforts to keep room descriptions, photographs, amenities and availability accurate. Minor differences may occur due to maintenance, improvements or circumstances at the time of the stay.

Internet, electricity, water, transport, third-party services and certain amenities may occasionally be interrupted by maintenance, weather, public utilities or events outside our control. We will make reasonable efforts to assist or provide an appropriate alternative where practical.

10 Safety and guest responsibility

Guests must use rooms, terraces, stairs, appliances, furniture and other facilities with reasonable care and follow safety instructions.

Parents and guardians are responsible for supervising children. Guests should inform us before booking about accessibility requirements or other essential needs so we can confirm whether suitable arrangements are available.

Travel, parking, excursions and third-party activities arranged independently by guests remain subject to the relevant provider’s terms and the guest’s own judgement.

11 Events beyond our reasonable control

We are not responsible for delay, interruption or inability to provide a booking caused by events beyond reasonable control, including severe weather, natural events, government restrictions, public emergencies, transport disruption, utility failure or similar circumstances.

Where such an event materially affects a confirmed booking, we will make reasonable efforts to communicate with you and offer an appropriate option consistent with the booking terms and applicable law.

12 Limitation of liability

To the extent permitted by applicable law, Himalay Homestays is not responsible for indirect, incidental or consequential loss arising from use of the website or a stay where such loss was not reasonably foreseeable.

Nothing in these terms excludes or limits liability that cannot lawfully be excluded, or affects mandatory consumer rights available under applicable law.

13 Website content and third-party services

Website text, branding, design and original content belong to Himalay Homestays or their respective owners and may not be commercially reproduced without permission.

Links, maps, reviews, payment systems and other third-party services are provided for convenience. Their availability, content and services are governed by their own terms and policies.

14 Governing law, disputes and changes

These terms are governed by the laws of India. We encourage guests to contact us first so that concerns can be reviewed and resolved fairly.

Subject to mandatory consumer rights and applicable jurisdiction rules, disputes shall be handled by the courts having appropriate jurisdiction in Dehradun, Uttarakhand.

We may update these terms when our services, booking process or applicable requirements change. The terms supplied with an existing confirmed booking will continue to govern that booking unless a lawful change is agreed or required.
